Payment information may be processed directly by Shopify, Shop Pay, PayPal, financing providers, banks, or other payment processors. MSJ Off-Road may not receive or store complete payment-card details.

Terms of Service

These Terms of Service govern your use of msjoff-road.com and purchases from MSJ Off-Road.

By using our website, submitting an order, paying an invoice, or purchasing a product or service, you agree to these Terms and any product-specific quote, invoice, build sheet, installation authorization, or written agreement associated with your order.

Eligibility and Acceptable Use

You must be legally capable of entering into a binding agreement to purchase from MSJ Off-Road.

You may not use our website or services:

  • For unlawful or fraudulent activity;
  • To interfere with website security or operation;
  • To transmit malware or harmful code;
  • To violate intellectual-property or privacy rights;
  • To submit false vehicle, payment, delivery, or identity information; or
  • To purchase products for prohibited use.

We may limit or refuse service where reasonably necessary to prevent fraud, protect safety, comply with law, or enforce these Terms.

Product Information

We make reasonable efforts to accurately describe products, pricing, estimated weights, dimensions, features, colors, capacities, compatibility, and lead times.

Because products may be revised, customized, manufactured in batches, or photographed under different conditions:

  • Actual colors and finishes may vary;
  • Measurements and weights may vary by configuration;
  • Product details may change without notice;
  • Images may include optional accessories not included in the listed price;
  • Hand-built or manufactured products may have minor cosmetic variations; and
  • Specifications should not be treated as engineering certification unless expressly stated.

We may correct errors, inaccuracies, or omissions and may cancel or modify an affected order. If we cancel an order because of our pricing or listing error, we will refund the amount paid for the cancelled item.

Vehicle Compatibility and Customer Information

The customer is responsible for providing complete and accurate information about the vehicle, including:

  • Year;
  • Make;
  • Model;
  • Trim;
  • Bed length;
  • Bed configuration;
  • Existing racks, covers, toolboxes, coatings, liners, accessories, or modifications;
  • Suspension modifications;
  • Vehicle damage; and
  • Intended use.

Fitment guidance is based on the information provided by the customer and available vehicle specifications.

Modifications, production differences, prior repairs, aftermarket equipment, vehicle tolerances, and inaccurate information may affect fitment. Additional work necessary because of undisclosed conditions may result in additional charges.

Vehicle Capacity and Safe Use

The customer is responsible for confirming that the vehicle can safely and legally carry the selected product, occupants, cargo, accessories, water, batteries, equipment, and other loads.

Published camper or topper weight does not represent the customer's complete installed or loaded vehicle weight.

Customers should consider:

  • Vehicle payload;
  • Gross vehicle weight rating;
  • Axle ratings;
  • Tire ratings;
  • Suspension;
  • Center of gravity;
  • Roof or rack ratings;
  • Cargo distribution; and
  • Applicable laws.

MSJ Off-Road does not increase or certify the manufacturer-rated payload, axle rating, towing rating, or gross vehicle weight rating of a customer's vehicle.

The customer is responsible for safe driving, regular inspection, maintenance, proper loading, and compliance with vehicle and product limitations.

Off-Road Use

Off-road driving involves inherent risk. Terrain, speed, impacts, vehicle flex, weather, loading, and driver judgment may affect the vehicle and installed equipment.

No camper, topper, accessory, or installation eliminates these risks. The customer assumes responsibility for operating the vehicle appropriately for the conditions and discontinuing use when damage, looseness, instability, unusual movement, or another unsafe condition is observed.

Orders and Acceptance

An order is subject to acceptance by MSJ Off-Road.

We may request additional information or decline an order due to:

  • Product availability;
  • Fitment concerns;
  • Pricing errors;
  • Suspected fraud;
  • Payment failure;
  • Shipping restrictions;
  • Safety concerns; or
  • Inability to complete the requested configuration.

A website confirmation does not necessarily constitute final acceptance of a customized order.

Deposits, Payments and Balances

Deposits, cancellation rights, and final-sale terms are governed by our Refund, Return and Cancellation Policy and any written order agreement.

Customers authorize MSJ Off-Road and its payment providers to charge the selected payment method for amounts shown during checkout, in an approved invoice, or under an agreed payment schedule.

The remaining balance must be paid before pickup, shipment, delivery, or installation unless otherwise agreed in writing.

Products remain the property of MSJ Off-Road until payment is complete to the extent permitted by law.

Taxes and Additional Charges

Prices may not include sales tax, use tax, duties, customs charges, installation, freight services, financing costs, delivery surcharges, or other charges unless expressly stated.

The customer is responsible for applicable taxes and government charges.

Financing

Financing may be provided by independent third parties. Approval, rates, interest, fees, payment schedules, cancellations, and refunds are governed by the customer's agreement with the financing provider.

MSJ Off-Road does not guarantee financing approval or financing terms.

Installation Services

Installation work is limited to the services shown in the customer's quote or work order.

The customer authorizes MSJ Off-Road to operate, move, inspect, photograph, and test the vehicle as reasonably necessary to complete or verify the installation.

MSJ Off-Road is not responsible for preexisting damage, hidden defects, corrosion, prior repairs, aftermarket wiring, unsafe modifications, weak mounting surfaces, or vehicle conditions that could not reasonably be identified before work began.

Additional issues discovered during installation may require approval for extra work, rescheduling, or return of the vehicle without completing the installation.

Customer Inspection

Customers should inspect products and installation work at pickup or delivery.

The customer must promptly report concerns and take reasonable steps to prevent further damage. Continued use after discovering an unsafe or damaging condition may affect available remedies.

Intellectual Property

The website and its content—including product names, designs, text, photographs, videos, logos, graphics, configurators, documents, and other materials—are owned by MSJ Off-Road or used with permission.

You may not reproduce, distribute, sell, scrape, reverse engineer, copy, or commercially exploit protected content without written permission.

Nothing in these Terms transfers ownership of MSJ Off-Road's product designs, branding, technical materials, or intellectual property.

Reviews and Submissions

Reviews and feedback must reflect honest experiences and may not contain unlawful, threatening, defamatory, infringing, deceptive, or private information.

When you voluntarily submit feedback, ideas, or suggestions, you allow MSJ Off-Road to use them without an obligation to compensate you, except where a separate written agreement states otherwise.

Third-Party Products and Services

Some products, services, links, financing tools, applications, and content are provided by third parties.

MSJ Off-Road is not responsible for a third party's website, availability, representations, privacy practices, financing decisions, or separate contractual obligations.

Third-party products may be governed by the original manufacturer's warranty and instructions.

Disclaimer of Warranties

Except for any written limited warranty provided by MSJ Off-Road and any warranty that cannot legally be excluded, products and services are provided on an “as available” basis.

To the maximum extent permitted by law, MSJ Off-Road disclaims warranties not expressly stated in writing.

Nothing in these Terms disclaims or limits an implied warranty or consumer protection that cannot lawfully be disclaimed or limited.

Limitation of Liability

To the maximum extent permitted by law, MSJ Off-Road will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost income, lost trips, loss of use, towing, lodging, substitute transportation, or business interruption.

To the maximum extent permitted by law, MSJ Off-Road's total liability arising from a product, service, or order will not exceed the amount the customer paid MSJ Off-Road for the product or service giving rise to the claim.

These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold MSJ Off-Road harmless from third-party claims arising from your unlawful conduct, misuse of a product, unauthorized modification, improper installation performed by you or another party, violation of these Terms, or infringement of another person's rights.

This section does not require a customer to indemnify MSJ Off-Road for MSJ Off-Road's own conduct where such indemnification is prohibited by law.

Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.

Any legal action that is not subject to another mandatory venue requirement will be brought in a court of competent jurisdiction located in Maricopa County, Arizona.

Before filing a lawsuit, the parties agree to make a good-faith attempt to resolve the dispute through direct written communication.

Severability

If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect, and the affected provision will be enforced to the maximum extent permitted by law.

No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

Entire Agreement

These Terms, together with applicable policies, invoices, quotes, configuration approvals, and written purchase agreements, constitute the agreement concerning the applicable order.

For conflicting terms, a specifically negotiated and signed written agreement controls over general website terms.

Changes to These Terms

We may update these Terms by posting a revised version with a new effective date.

Changes do not retroactively alter a completed purchase unless required by law or agreed to by the customer.
